State Records Appeal “DENIED” based on questionable CH Recorder Mulvey’s sworn testimony

Committee "had no choice" but to trust the testimony of the Cedar Hills Recorder Colleen Mulvey

CEDAR HILLS CITIZENS FOR RESPONSIBLE GOVERNMENT's Appeal to the Utah State Records Committee was DENIED they said solely based on her testimony provided under penalty of perjury. 

CHCRG has waited a few days for her to correct, alter, clarify her questionable testimony and provide the complete set of records, providing that opportunity in writing the very next day June 15, 2018.  No response yet.

But Ms. Mulvey, where are the records you testified you gave CHCRG researcher Ken Cromar?  For an honest person wanting to prove herself truthful, it should be a very easy thing to hit the "Resend" button, right Ms. Mulvey?

Please find a GRAMA request below, which you did not properly and “completely” fulfill back in February.   Would you send a receipt of this GRAMA request with today’s date please?  I assume you’ll immediate fulfill this as you did not do so originally, right?   Any explanation on your oversight please?

Yesterday you testified before the State Records Committee swearing that you provided me / CHCRG the records, but when I asked when you provided them you did not know.  Could it be because you did not provide them to me as you swore you did?  I have extensively reviewed my files and find NO RECORD OR EVIDENCE of you providing the records.  The Committee said that their “Denial” was based on your sworn testimony. Will you please FW them “again” before the end of day today please?

BTW, I have never seen any of those two final 6-page samples from two larger docs of 258 and 435 pages from Tab 13 in the 3-ring binder Cedar Hills provided the Records Committee, let alone any of the total “693" pages.  What are those pages exactly please?  Where did they come from?

Also, may I ask if you have any regrets or questions in your mind regarding the accuracy of your testimony yesterday at the State Records Committee Hearing provided under oath and penalty of perjury?  Any clarifications you care to offer today please?  I sincerely hope that you did not perjure yourself and/or that you’ll immediately rectify any errors or omissions please.

CHCRG Letters to Utah State Record Committee plea for help

After numerous delays, CHCRG's February APPEAL for Hearing before the Utah State Records Committee finally happened Thursday June 14, 2018 at the Records Office in Salt Lake City.

As part of Cedar Hills Citizens for Responsible Government's presentation by former Councilman Ken Cromar and CHCRG's lead researcher / filer of the APPEAL, he read the following letters into the record…

I believe that everyone would benefit if Cedar Hills would be more forthcoming with information regarding the golf course to residents that inquire about the activities of the golf course.  …

…When [GRAMA] requests are dodged, delayed or provided at a high cost, this sows distrust with residents.

Jerry Dearinger, 2011 candidate for CH Mayor, and CHCRG legal advisor wrote in part…

…If the records do not now exist, it is only because of the City's failure to properly maintain them and I cannot conceive as to why they will not verify, or at least state that they have no reason to believe the records Mr. Crawley provided back to them have been tampered with and are thus inaccurate.  Why is the City now spending so much money on this hearing rather than just stating that they either have or have not produced all records requested? …

As a talk show host of more than 25 years and as a Citizen Reporter I have personally GRAMA requested golf related records and when stonewalled was compelled to involve the services of Government Records Ombudsman Rosemary Cundiff.  Even with her assistance we don’t believe we obtained an honest, complete fulfilling of my GRAMA request. …

…Integrity of lawful GRAMA requests, first amendment rights, and respect for all citizens is a prerequisite to restoring trust between the people and those who serve them.  We declare that silence on this critical matter has become a de facto endorsement of records request violations under the guise of incompetence or outright dishonesty.  …

…Please ORDER Cedar Hills to provide all responsive records and sign documentation declaring they know their obligations under the law have been fulfilled.

Gary Gygi: “Zero intention to run for any office again…”.

While seeking "input" and "review" of his articles he claimed the Daily Herald asked him to write.

The Cedar Hills former Mayor Gygi had just left office being replaced by Jenney Rees, and the subject of his possibly using this "free press" opportunity to prepare for some other run for office?  At the end of a long series of text exchanges, his reply was,

Ken at this point in my life I have zero intention to run for any office again

To which Ken Cromar, a former CH Councilman 1994 to 2000, and researcher for CHCRG replied…

This is excellent news.  No matter how many "people ask me to run", — I wil hold ou to your word.

When Utah County voters cast their votes in the 2018 primary and general elections, it won’t be by mail, unless they’re signed up for absentee voting.

Despite running an entirely by-mail election in 2017 for a special congressional election and municipal elections, Utah County decided to make a return to traditional voting this year.

For the 2017 municipal elections, cities chose to contract with the county to do vote-by-mail in overwhelming numbers, many of them citing improvements in voter turnout as a main reason for the switch.

Mayor Rees & CH Mgr Goodwin met with CHCRG’s Dearinger & Cromar

Monday afternoon January 22, newly sworn in Mayor Jenney Rees accepted CHCRG's Ken Cromar & Jerry Dearinger's request to meet to establish a cooperative relationship, and discuss various City issues, and ask and answer questions, in the hope of working cooperatively regarding City concerns.

Though respectful, the approximately 1 hour and 20 minutes discussion covered numerous items, some of which may be reported on here at CHCitizens.org later.

The followup email reflected the tone…

 

Mayor Rees & Chandler,

Thank you for taking time from your busy schedule to visit yesterday with Jerry Dearinger and I to discuss a few things, as you Jenney begin your term as our newest Mayor.

Appreciated the respectful, frank exchange. Thank you. Hope you feel the same? 

I don’t know about you or Jerry, but I will reflect on our visit for a while, and may want to follow up if you don’t mind?

Our family will continue to pray for success in the good things you do for the entire CH community.
